This electronic record is generated by a computer system and does not require any physical or digital signatures. By accessing Flocco or using our services, you are consenting to be bound by this User Agreement. Please ensure that you read and understand all the provisions of this document before you start using the Flocco, as you shall be bound by all the terms and conditions herein of this electronic contract.

1. Collection of Customer’s Information

In order to enhance the customer experience and provide Flocco Services, we collect information about You from two sources: (i) information You voluntarily give to us; and (ii) information automatically collected when You visit Our Platform or use any of Our Services.

1.1. This ‘Privacy Policy for Households/Customers’ delineates the categories of information gathered from Customers, encompassing Sensitive Personal Data or Information (as delineated below), the rationale, methods, and modalities of utilization of such information, and the manner and recipients of such information's disclosure or transfer.

1.2. Non-Personal Information: When You visit the Flocco’s Digital Platform, We may collect certain non-personal information such as Your internet protocol address, operating system, browser type, internet service provider, aggregate user data, browser type, software and hardware attributes, pages You request, number of click, search history and result selected, active seconds or minutes on the Platform, frequency of Your visit to the Platform, the date and time of Your visit to Platform or use of the Services and cookie information, etc. This type of information does not identify You personally.

1.3. Customer’s Personal Information: When accessing Flocco services or Local Kirana Stores services listed on the Flocco, you may be required to provide certain demographic and other information. Such information may encompass, but is not restricted to:

Should you desire to modify our Access or Permissions, you retain the option to do so within your device’s settings.

1.5. Push Notifications: We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn off in your Device’s settings.

1.6. Mobile Device Access & Data: We reserve the right to require that consumers allow access or permission to specific functions on their mobile devices, including access to the storage. If you want to change our access or permissions, you can do so using your device's settings.

1.7. Automatic Information: We receive and store certain types of automatic information whenever You access Our Digital Platform. We use cookies primarily for user authentication but may also use them to improve the quality of Our Services by storing user preferences and tracking user trends. Further, the we may also collect information about your preference and settings such as time zone and language, your searches and the results You selected from the searches. 1.9. Communication Information: When You send emails or other communications to Us, We may retain those communications in order to process Your inquiries, respond to Your requests and improve Our Services.

1.10. Information from Third Parties: Flocco may receive information about You from third parties, such as Kirana Stores, Partners or our affiliated companies or if You use any of the other websites/apps we operate or the other services we provide.

2. Sources of Customer’s Information

We obtain the categories of Customer’s personal information listed above from the following categories of sources:

2.1. Directly from You. For example, from forms you complete on our Digital Platform, preferences you express or offer via our Services, or purchases you make using our Services.

2.2. Indirectly from You. For example, from observing Your activity on our App.

2.3. Automatically from You. For example, through cookies We or our Service Providers install on Your Device while You travel through our Service.

2.4. From Service Providers. For example, third-party vendors to monitor and analyse the use of our Service, third-party vendors for payment processing, or other third-party vendors that We use to provide the Service to You.

3. Use of Customer’s Personal Data

The Flocco may use Customer Personal Data for the following purposes:

3.1. To provide and maintain our Service, including to monitor the usage of our Service.

3.2. To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

3.3. To resolve disputes that may arise with the use of Our services on the Platform.

3.4. For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

3.5. To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

3.6. To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

3.7. To manage Your requests: To attend and manage Your requests to Us.

This allows us to improve and enhance the safety and security of our Services, develop new features and products.

3.11. Flocco may use the information collected to communicate with you about products, services, promotions, studies, surveys, news, updates, and events. Flocco may also request your feedback on the Services.

3.12. We may use your information for any other purpose disclosed to you at the time we collect or receive the information, or otherwise with your consent.

4. Information Storage & Safety

4.1. All information is saved and stored on Flocco’s servers, which are secured with passwords to ensure no unauthorised person has access to it. Once your information is in Our possession We adhere to strict security guidelines, protecting it against unauthorized access.

4.2. Flocco shall take reasonable steps to help protect Your rights of privacy and Your information (personal or otherwise) in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, or destruction of such information, in compliance with the applicable laws. You expressly consent to the sharing of Your information with third party service providers, including vendors, Merchants, insurance agents and insurers, promotion and marketing partners, consultants, research firms, business partners, financial service providers, payment gateways, to process payments and manage payment card information.

4.3. Payment processing is conducted through a Third-Party Payment Gateway; therefore, you are subject to their Policy in addition to this Privacy Policy. Furthermore, we do not collect or store any information related to users' Debit or Credit Cards.

4.4. We exercise due diligence in safeguarding Customer data. Technical measures are implemented to mitigate unauthorized access to data and to prevent accidental loss, destruction, or damage to data. Our employees handling the data undergo training to ensure protection against illegal or unauthorized usage. Furthermore, we prioritize the security of your information during transmission, enabling sensitive data such as credit card numbers and login credentials to be securely transmitted.

4.5. Although we shall try our best to protect Your data, we cannot take any guarantee for the security of Your data transmitted through the Platform. You play an important role in keeping Your personal information secure. You shall not share Your user’s name, password, or other security information for Your account with anyone.

5. Sharing Customer’s Personal Information

5.1. We may share Customer personal information in the following situations:

5.1.1. With Kirana Stores: We might share your information with the Local Kirana Store whereby you have made a purchase of the grocery products.

5.1.2. With Service Providers: We may share Customer personal information with Service Providers to monitor and analyse the use of our Service, for payment processing, and to contact you.

5.1.3. With Agencies: We may share your information with the governmental agencies whenever it is required under any law.

5.1.4. With Affiliates: We may share Customer information with Our affiliates, in case we will require those affiliates to honour this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

5.1.5. With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.

5.2. We may use third party service providers to help us operate our business and the App or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

6. Billing & Payment Information

6.1. Third-party payment processors help us securely process your payment information. We adhere to all regulatory requirements and adopt extra commonly acknowledged industry standards. In addition to our privacy policy for, your debit and credit card information will be subject to the privacy policies of third-party payment processors. We recommend that you study their privacy policies.

6.2. PLEASE READ THE PRIVACY POLICY ON THE PAGE OF THE PAYMENT PROCESSOR THAT YOU ARE DIRECTED TO REGARDING THE USE, STORAGE AND PROTECTION OF YOUR DEBIT AND CREDIT CARD INFORMATION BEFORE SUBMITTING ANY DEBIT AND CREDIT CARD INFORMATION.

7. Customer Data Transfer

7.1. Your Personal Information may be transferred across national borders because We may have servers located outside India, and the companies we hire to help us run our business may be located in different countries around the world.

7.2. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

7.3. Flocco will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place in accordance with the data protection laws including the security of Your data and other personal information.

8. Retention of Customer Data

8.1. Flocco will retain Customer Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Customer Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

8.2. Flocco will also retain Usage Data of the customer for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

9. Data Deletion Request by Customer

9.1. Flocco respects customer’s privacy, Customer may request deletion of their data or information at any time by contacting Flocco through “Contact Us” section available in this Privacy Policy.

9.2. Following an account deletion request, Flocco deletes the customer’s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or for completing the transaction or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. Because we are subject to legal and regulatory requirements relating to Independent Partners, this generally means that we retain their account and data for a minimum of 5 (five) years after a deletion request.

10. Data request from Law Enforcement Agency

10.1. We do not sell, trade, or otherwise transfer our Customer’s Personal Information except in accordance with this Policy. We do not share any information that directly identifies you with any third party, except in the following limited cases:

10.1.1. As required to comply with applicable law or regulation, or to comply with law enforcement;

10.1.2. To respond to claims and/or legal process;

10.1.3. To protect our rights or our property, or to enforce our Terms of Service;

10.1.4. To help ensure the safety of the public or an individual;

10.1.5. To prevent behaviour that is (or that we think may be) illegal or unethical;

11.1. You hereby acknowledge and agree that when You use the Flocco, there may be certain third-party links which may direct You to other websites or applications not operated/maintained by the Flocco to serve advertisements when You visit our Digital Platform. These companies or third-party platforms may use Your information (including Your name, address, email address, or telephone number) about Your visits to those Website and other Platform in order to provide advertisements about services of interest to You.

11.2. This Privacy Policy does not apply to information that You provide to, or that is collected by, any Other Third-Party Site through the Flocco. The manner in which Your information is collected, received, stored, processed, disclosed, transferred, dealt with and handled by such Other Site(s) is governed by the terms and conditions and privacy policy of the respective Other Site(s). Flocco hereby expressly disclaims all liabilities with respect to the manner in which the Other Site(s) collects and/or uses Your information.

12. Web Browser Cookies

12.1. Cookies are small text files that are stored on browsers or devices by apps, online media, and advertisements. Flocco uses cookies and similar technologies for purposes such as:

12.1.1. authenticating users

12.1.2. remembering user preferences and settings

12.1.3. determining the popularity of content

12.1.4. delivering and measuring the effectiveness of advertising campaigns

12.1.5. analysing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services

12.2. Flocco may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Users may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Flocco’s Digital Platform may not function properly.

12.3. We may utilise third-party software for ad serving, email marketing, and other interactive marketing operations. This third-party software may use cookies or other tracking technology to monitor and improve your online experience with us. To avoid cookie storage, go to your browser's settings and select the "disable cookies" option. However, this can limit the functionality of our services

13. Connecting your Account via Email

13.1. You can choose to provide explicit consent to connect your email accounts with your Flocco Account. Once connected, Flocco will securely access and analyse the relevant contents related to the Services provided by Flocco. We encourage you to review your Personal Information prior to signing in through the applicable service.

13.2. Flocco does not under any circumstances store your email messages, email messages headers, message bodies, or attachments. Flocco only accesses your email account for scanning purposes and displays information immediately as it is returned. Flocco requests read-only access to your email account and will not attempt to alter or modify your email account or email messages in any way except as otherwise agreed by you through additional consent to write permission in your account with respect to the services from Flocco you are opting.

14. Marketing, Advertisement & Preference

14.1. We utilise customer’s personal information to send marketing via various channels, including post, phone, social media, email, SMS, application notifications, and quiet notifications to check app installation status. We may also utilise your personal information for online paid marketing activities such as retargeting.

14.2. We may permit certain third-party companies to help us tailor advertising that we think may be of interest to users and to collect and use other data about user activities in the Mobile Application. These companies may deliver ads that might place cookies and otherwise track user behavior.

14.3. We also use technology to help us understand your personal preferences and interests so that we can send recommendations and marketing communications that are likely to be of more interest to you. Using technology in this way is sometimes known as profiling.

15. Account Deletion Request

15.1. You may at any time review or change the information in your account or terminate your account by:

15.1.1. Logging into your account settings and updating your account.

15.1.2. Contacting us using the contact information provided below in the “Contact Us” section.

15.2. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigation, enforce our Terms of Use and/or to comply with legal requirements.

16.2. And if you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

16.3. Users may opt in/opt out from marketing notifications, Live location sharing, updates and news received from the Flocco by checking their device settings at any time.

16.4. If you wish to unsubscribe from emails sent by us, you can also do so at any time by clicking on the "unsubscribe" link that appears in all emails and by adjusting the settings on your device to turn off notifications from our app. Otherwise, you can always contact us to update your contact preferences. You may also object to profiling relating to direct marketing by contacting us at details given in Contact Us clause.

17. Compliance with Children’s Privacy

17.1. We recognize the importance of children's safety and privacy. For that reason, we never collect or maintain information at our App from those we actually know are under 18 years of age, and no part of our App is structured to attract anyone under the age of 18.

17.2. Flocco is very sensitive to privacy issues regarding children. If a parent or guardian becomes aware that his or her child has provided us with Personal Information, he or she should write to us at the details given in the Contact Us clause.

18. Choice And Transparency

18.1. Flocco enables customers to access and/or control data that Flocco collects, including through:

18.2. Privacy Settings

18.2.1. Customer can enable/disable Flocco to collect location data from their mobile devices through their device settings, which can be accessed via the Settings > Privacy > Location menu.

18.2.2. Customers can enable/disable Flocco to share their real-time location data from their mobile devices with their drivers through their device settings, which can be accessed via the Settings > Privacy > Location menu.

18.3. Device Permissions

18.3.1. Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. Please check the available settings on your device or check with your provider.

18.4. Customer’s Personal Information is extremely important to us. Your information resides on a secure server that only selected personnel have access to. Promotional and referral codes are random alphanumeric sequences that are encrypted. In addition to our precautions, it is important that you do not share your password with anyone. Although we try our best to protect your information, we cannot eliminate security risks associated with Personal Information.

19. Grievance Redressal

19.1. In case you face nay issues or dissatisfaction in relation to the privacy practices of Flocco, you shall require to file a formal complaint with the customer support executive of the Flocco, prior to pursuing any other recourse.

19.2. The complaints can be lodged at info@flocco.co, and upon lodging a complaint You agree to provide complete support to the customer support executive with such reasonable information as may be sought by them from You. The decision of the Flocco on the complaints shall be final and You agree to be bound by the same.

20. Your Rights under DPDP Act

20.1. You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try our best to respond to You as soon as possible.

20.2. Please Note, we may process Personal Data under the following conditions:

20.2.1. If you have given your consent;
