This Bike Rider’s Privacy Policy (“Privacy Policy”) explains how Flocco In Private Limited (hereinafter collectively referred as “Flocco", “Company”, “we”, “us”, or “our”) collects, uses, discloses, and otherwise processes personal information in connection with the Flocco and our Platform and any other interactions you have with Flocco as a prospective or active Bike Rider to facilitate deliver service, in pursuance of Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023.

This Privacy Policy does not cover or address households, Kirana Stores or other personnel.

1. Collection of your Information

We may collect varieties of information from the Bike Riders in various ways:

1.1. Your Personal Information: When you use Flocco to deliver Kirana Store’s grocery products to the households/customers, or when you communicate or interact with us, we may collect information from you, such as your name, phone number, email address, preferred region and city, physical address, vehicle and registration information, date of birth, Aadhar Number, driver’s license number, insurance information, Profile Picture (which may be displayed to customers or used for identification purposes within the app).

1.2. Information from Kirana Store: We may receive some additional information regarding the disclosure of your personal information to us from our Kirana Store partners whereby you are engaged with to provide deliver services.

1.3. Location Information: We collect your real-time location information while you are actively using the Flocco to perform delivery tasks. This allows us to track you and give real-time update to households/customers to deliver orders efficiently and optimize delivery routes based on your current location.

1.4. Device Information:

1.4.1. Device Identifiers: We may collect unique device identifiers, such as device ID, IP address, or mobile advertising ID, to identify your device and ensure the security and functionality of the app.

1.4.2. Item Information: We may also collect information about the device you use to access the app, including device type, operating system, browser type, and version, to optimize app performance and provide technical support.

1.5. Delivery Information: We collect information about how you use the Flocco Platform specific to the orders that you accept, cancel, including, without limitation, the rates of acceptance, cancellation, the total number of deliveries you make, the date and time of delivery acceptances, cancellations as well as the date and time of completions, time required to complete deliveries, route information associated to each order.

1.6. Mobile Device Access & Data: We may request access or permission to certain features from your mobile device, including your mobile device’s storage. If you wish to change our access or permission, you may do so in your Device’s settings.

1.7. Device information: such as your mobile device ID number, model, and manufacturer, version of your operation system, phone number, country, location, and any other data you choose to provide.

1.8. Automatic Collection: When You access Flocco or use the Services by or through a mobile device, We may collect certain usage data automatically, Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

2. Use of your Information

2.1. We may use your ‘Personal Information’ to determine your eligibility including verifying your information to ensure its accuracy and validity; verify your identity; onboard you to using the Flocco Platform; fulfill orders by sharing your contact information with Households/Customers; assist and/or intervene if there are safety and security concerns; send you important information regarding the Flocco Platform, such as certain changes to our terms, conditions, policies and/or other administrative information.

2.2. We may use your ‘Delivery Information’ to enable you to provide the Delivery Service by indicating your availability, accepting orders, viewing your fulfilled orders, and managing your orders; Collect, confirm and verify information about Delivery Service performed by you; Perform analytics, detect activity patterns on our Platform, determine the effectiveness of our promotional campaigns, and otherwise research usage; Schedule and otherwise facilitate order pick-up and/or delivery; and Test and develop new features and functionality and otherwise enhancing the Platform and Services.

2.3. We may use ‘Device Information’ to provide, maintain, improve and develop the Platform and Service; to perform analytics, detect activity patterns on our Platform and Service, determine the effectiveness of our promotional campaigns, and otherwise research usage; to collect, confirm and verify information about Services performed by you; and to test and develop new features and functionality and otherwise enhance the Platform and Services.

2.4. We may use ‘Location Information’ to coordinate fulfillment of all delivery orders placed to Kirana Stores network. Flocco also use the location information to track the progress and completion of deliveries, and disclose it to Local Kirana Store from which you have accepted delivery order so that they can track the order(s) and/or communicate with you.

2.5. In addition to the above, Flocco may use your personal information to:

2.5.1. Maintain the safety, stability and security of our Platform.

2.5.2. Provide, personalize, measure and improve our advertising and marketing.

2.5.3. Legal and Law Enforcement Agency’s requirements and proceedings.

2.5.4. Enforce Flocco’s rights.

2.5.5. We may use your personal information for a specific purpose not contemplated by this Privacy Policy. In such an event, we will specifically disclose that use to you.

2.5.6. Further we may disclose your information to our Service Providers, Customers/Households, Affiliates, to complete our Business Transactions and to fulfill our legal obligations.

3. Storage & Protection of your Information

3.1. Data Storage: We utilise secure data collection, storage, and processing techniques to prevent unauthorised access, alteration, disclosure, or destruction of your personal information, username, password, transaction information, and app data. Our team works relentlessly to secure your information and assure the platform's security and integrity. We also have independent auditors review the security of our data storage and financial information processing systems.

3.2. Data Protection: Flocco deploys physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our Digital Platform. However, no security system is impenetrable and we cannot guarantee the security of our systems. Please recognize that protecting your personal information is also your responsibility. Accordingly, we strongly recommend that you change your passwords often, use a combination of letters and numbers, make sure you use a secure browser, and otherwise take precautions when communicating your personal information on the internet. If you know or have reason to believe that your Account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your Account, please contact us following the instructions in the ‘Contact Us’ section below.

4. Sharing your Personal Information

4.1. We may share Your personal information to the following categories of persons:

4.1.1. With Customers/Households: We might share your personal information including location information to the customers/households to give them real-time update of their grocery orders.

4.1.2. With IT Service Providers: We may share Your personal information with our IT Service Providers to monitor and analyse the use of our Service.

4.1.3. For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

4.1.4. With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

4.1.5. With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.

4.2. Third Party Service Providers: We may use third party service providers to help us operate our business and the App or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

5. Retention of your Personal Data

5.1. Flocco will keep Your Personal Data only for the purposes outlined in this Privacy Policy. We will preserve and use Your Personal Data only to the extent necessary to meet our legal obligations (for example, if relevant laws compel us to keep your data), resolve disputes, and enforce our legal agreements and policies.

5.2. Flocco retains the Personal Information collected where an ongoing legitimate business requires retention of such Personal Information. In the absence of a need to retain your Personal Information as specified herein, we will either delete or aggregate your Personal Information or, if this is not possible then We will securely store your Personal Information and isolate it from any further processing until deletion is possible.

6. Control over the Information

6.1. Requesting Data Copy: You may submit a request to get a copy of your Personal Information, to understand what we collect and how we share your Personal Information, or to delete your Personal Information. We will need to verify your identity before processing your request, which may require us to request additional personal information from you or require you to log into your account.

6.2. In certain circumstances, we may decline such a request, such as when we are unable to verify your identity, or when we are unable to delete your information for legal or regulatory reasons. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

7. Data Deletion Request by Bike Rider’s

7.1. Flocco respects your privacy, you may request deletion of your data at any time by contacting us through the “Contact Us” section available in this Policy.

7.2. Following a data deletion request, Flocco deletes the Bike Rider’s data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or for completing the transaction or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. Because we are subject to legal and regulatory requirements relating to Independent Partners, this generally means that we retain their account and data for a minimum of 5 (five) years after a deletion request.

8. Data request from Agencies

8.1. We will not sell, trade, or transfer your Personal Information except in line with this policy. We do not share any information that directly identifies you with any third party, except in the following limited circumstances:

8.1.1. As required to comply with applicable law or regulation, or to comply with law enforcement;

8.1.2. To respond to claims and/or legal process;

8.1.3. To protect our rights or our property, or to enforce our Terms of Service;

8.1.4. To help ensure the safety of the public or an individual;

8.1.5. To prevent behaviour that is (or that we think may be) illegal or unethical;

9. Email & Marketing opt outs

9.1. If you no longer want to receive contact, emails, or other communications from us, you can opt-out at any time by:

9.1.2. Login into your account setting and updating your preferences

9.2. If you want to stop receiving communications from third parties, you must contact them directly.

9.3. Users may opt in/opt out from marketing notifications, Live location sharing, updates and news received from the Flocco by checking their device settings at any time.

9.4. If you wish to unsubscribe from emails sent by us, you can also do so at any time by clicking on the "unsubscribe" link that appears in all emails and by adjusting the settings on your device to turn off notifications from our app. Otherwise, you can always contact us to update your contact preferences. You may also object to profiling relating to direct marketing by contacting us at details given in Contact Us clause.

10. Tracking Technologies & Google Analytics

10.1. Most browsers allow you to adjust your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; disable existing cookies; or set your browser to automatically reject cookies. Blocking or deleting cookies may negatively impact your experience using the Platform, as some features may not work properly. Depending on your mobile device and operating system, you may not be able to delete or block all cookies, you may not be able to block non-cookie technologies or the changes to your settings may have no effect.

10.2. We use Google Analytics to recognize you and link the devices you use when you visit our Service on your browser or mobile device, login to your Account on the Platform, or otherwise engage with us. We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Platform and to tailor our content to you.

11. Compliance with Children’s Privacy

11.1. We value children's safety and privacy. As a result, we never recruit anybody under the age of 18, never collect or keep any such information on our App from people we know are under the age of 18, and no aspect of our Digital Platforms are designed to attract anyone under the age of 18.

11.2. Flocco is very sensitive to privacy issues regarding children. If a parent or guardian becomes aware that his or her child has provided us with Personal Information, he or she should write to us at the details given in the Contact Us clause.

12. Your Rights under DPDP Act

12.1. You can exercise your rights to access, rectification, cancellation, and opposition by contacting us. Please be aware that we may request that You authenticate Your identity before responding to such inquiries. If you make a request, we will do our best to react as quickly as possible.
