Flocco In Private Limited or any of its affiliates or associate companies or subsidiaries (hereinafter collectively referred as “Flocco", “Company”, “we”, “us”, or “our”), prescribes this Privacy Policy (the “Privacy Policy” / “Policy”), last updated on the date mentioned above, describes how we collect, use, store and disclose your (hereinafter referred to as “You”, “User(s)”, or “Retail Store”, or “Your”) Personal Information when you visit Flocco or market and sell your services by using Flocco, the Flocco email plugins, the Flocco chrome extension and any other website or mobile application or plugins that links to this Privacy Policy in Our capacity as a controller of your Personal Information.

This electronic record is generated by a computer system and does not require any physical or digital signatures. By accessing Flocco or using our services, you are consenting to be bound by this User Agreement.

Further, this Privacy Policy explains what information of yours as a Retail Store will be collected when you access the Flocco Services or Market and Sell your grocery products using Flocco, how such Personal Information will be used, store, shared and how you can control the collection, correction and/or deletion of your Personal Information in pursuance of Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023.

Supplemental clauses in the privacy policy or documents that may be posted on Flocco from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to the Privacy Policy time to time. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy, and you waive any right to receive specific notice of each such change.

A. This Privacy Policy applies to the Retail Stores listed with the Flocco to market and sell their grocery products.

B. We collect your information in order to provide and continually to improve our services for the Kiaran Stores and to protect your privacy. Our Privacy Policy is subject to change at any time without a notice, to make sure you are aware of any changes, please review this Policy periodically. No third-party may access or process sensitive personal information held by us without having first entered into a Confidentiality Agreement.

1. Collection of Retail Store Information

1.1. We may collect your personal identification information pertaining to your Retail Store in a variety of ways, including:

1.2. Retail Store’s Information: If you are a Retail Store listed with the Flocco to market and sell grocery products, we may ask you to provide us with certain personal and business information to perform KYC process, that may include:

1.2.1. Personal Identifiable Information, such as:

1.2.1.1. Retail Store Name;

1.2.1.2. Store dimension;

1.2.1.3. Store’s full Address;

1.2.1.4. Longitude and Latitude;

1.2.1.5. Area PIN Code etc.;

1.2.1.6. Name of the Proprietor.

1.2.2. Grid Name (Specific to Flocco IN, assigned by Flocco)

1.2.3. Retail Store GST Number (declaration in case of no GST No.);

1.2.4. Bank Account details such as Account No., IFSC Code, Account Name, Account type;

1.2.5. Document copies e.g. Aadhar Card, PAN Card, FSSAI License, Store License, GST Certificate or Any Statutory License etc.

1.3. Geo-Location Information: We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our Access or Permissions, you may do so in your device’s settings.

1.4. Device information such as your mobile device ID number, model, and manufacturer, version of your operation system, phone number, country, location, and any other data you choose to provide.

1.5. We obtain the categories of Retail Store’s personal information listed above from the following categories of sources

1.5.1. Directly from You. For example, from forms you complete on Flocco Service page, preferences you express or offer via our Services, or purchases you make using our Services.

1.5.2. Indirectly from You. For example, from observing Your activity on our Flocco.

1.5.3. Automatically from You. For example, through cookies We or our Service Providers install on Your Device while You travel through our Service.

2. Use of Retail Store’s Information

2.1. Having accurate information about the Retail Store permits us to provide a smooth, efficient, and customized Service experience to all the concerned parties. Specifically, the Flocco may collect the details if there is any issue arises and improve its service by looking into the personal information; to Personalize User Experience; to improve our Working; to Process Payments; to run a promotion, contest, survey; to send periodic emails; Research and Development; or Legal Requirements etc.

2.2. Accurate information of the Retail Store allows us to give a customized experience to the households/customers to search their Local Retail Store.

2.3. The Flocco may use Retail Store’s Information for the following purposes:

2.3.1. To provide and maintain Service to the households/customers, including to monitor the usage of Service.

2.3.2. For the accurate listing and pricing of the grocery products;

2.3.3. For the performance of a contract: the development, compliance and undertaking of the purchase contract for the services you have purchased or of any other contract with Us through the Service.

2.3.4. To manage Your requests: To attend and manage Your requests you made to Us.

2.3.5. For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

2.3.6. For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, and marketing strategy.

3.2. We take due care to protect Retail Store’s data. Technical measures are in place to prevent unauthorized access to data and against accidental loss or destruction of, or damage to, data. The employees who are dealing with the data have been trained to protect the data form any illegal or unauthorized usage. We work to protect the security of your information during the transmission, this allows sensitive information such as credit card and numbers, and login credentials to be transmitted securely.

3.3. We take reasonable steps to help protect Retail Store’s personal information in an effort to prevent the loss, misuse, and unauthorized access, disclosure alteration and destruction. It is your responsibility to protect your usernames and password to help prevent anyone from accessing or abusing your accounts and services. You should not use or reuse the same passwords you use with other accounts as your password for our Services.

You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

5.3. Use of our services after an update constitutes consent to the updated Privacy Policy to the extent permitted by law.

6. Payment Information

6.1. We use third party payment processors to assist and manage us in processing your payment information securely. we follow all legal requirements and implement additional generally accepted industry standards.

7. Data Storage and Transfer

7.1. Personal Information and files including their backups are processed and stored on Flocco servers and the servers of companies we hire to provide services to Us. Your Personal Information may be transferred across national borders because We may have servers located outside India, and the companies we hire to help us run our business may be located in different countries around the world.

7.2. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

7.3. Flocco will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place in accordance with the data protection laws including the security of Your data and other personal information.

8. Retention of Retail Store Information

8.1. Flocco will retain Retail Store information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

8.2. Flocco retains the Personal Information collected where an ongoing legitimate business requires retention of such Personal Information. In the absence of a need to retain your Personal Information as specified herein, we will either delete or aggregate your Personal Information or, if this is not possible then We will securely store your Personal Information and isolate it from any further processing until deletion is possible.

9. Data Deletion Request by Retail Store

9.1. Flocco respects Retail Store’s privacy, Representative of the Retail Store may anytime delete their account by visiting “Delete Account” section available in the Flocco App. By providing required details an account created by the Retail Store can be deleted anytime.

9.2. Following account deletion, Flocco deletes the user’s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or for completing the transaction or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. Because we are subject to legal and regulatory requirements relating to Independent Partners, this generally means that we retain their account and data for a minimum of 5 (five) years after a deletion request.

10. Requests from Agencies

10.1. We do not sell, trade, or otherwise transfer Retail Store’s Information except in accordance with this Policy. We do not share any information that directly identifies you with any third party, except in the following limited cases:

10.1.1. As required to comply with applicable law or regulation, or to comply with law enforcement;

10.1.2. To respond to claims and/or legal process;

10.1.3. To protect our rights or our property, or to enforce our Terms of Service;

Users may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Flocco’s Digital Platform may not function properly.

12. Marketing & Advertisement

12.1. We use your personal information to send you marketing by post, telephone, social media platforms, email, SMS, application notifications and silent notifications to track installation status of the application. We may also use your personal information to carry out online paid marketing activities in the nature of retargeting.

12.2. We may permit certain third-party companies to help us tailor advertising that we think may be of interest to users and to collect and use other data about user activities in the Mobile Application. These companies may deliver ads that might place cookies and otherwise track user behavior.

13. Account Deletion & Email opt outs

13.1. You may at any time review or change the information in your account or terminate your account by contacting us using the contact information provided below.

13.2. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigation, enforce our Terms of Use and/or to comply with legal requirements.

13.3. Emails and Communications – If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out any time by:

14.2.2. Users can enable/disable Flocco to share their real-time location data from their mobile devices with their drivers through their device settings, which can be accessed via the settings > Privacy > Location menu.

14.3. Device Permissions

14.3.1. Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. Please check the available settings on your device or check with your provider.

15.1. You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, we will try our best to respond to You as soon as possible.
